The use of the medium 'TED' does not imply compliance with procurement regulations that are not mandatorily required by law or procurement regulations according to the case law of the European Court of Justice. This open-house procedure was first published on April 5, 2024, in the Supplement to the EU Official Journal under number 202404-2024 (so-called initial announcement). AOK Baden-Württemberg (AOK) has expanded the procurement needs for this procedure with number 465426-2024 (first follow-up announcement), number 588304-2024 (second follow-up announcement), and number 654935-2024 (third follow-up announcement). AOK intends to conclude non-exclusive discount contracts according to § 130a Abs. 8 SGBV for medicines with the active ingredients named in Annex 3 to the participation conditions with all suitable pharmaceutical companies. The contract duration for the active ingredients according to item 5.1 of the initial announcement (so-called starting active ingredients) begins no earlier than July 1, 2024, and lasts a maximum of 24 months (except for the active ingredient Ustekinumab; maximum 6 months). The contract duration for the active ingredients according to item 5.1 of the first follow-up announcement begins no earlier than October 1, 2024, and lasts a maximum of 21 months. The contract duration for the active ingredient combination according to item 5.1 of the second follow-up announcement begins no earlier than December 1, 2024, and lasts a maximum of 4 months. The contract duration for the active ingredients according to item 5.1 of the third follow-up announcement begins no earlier than January 1, 2025, and lasts a maximum of 18 months. The contract duration ends no later than June 30, 2026. A contract can be concluded at any time from July 1, 2024, to June 30, 2026, at the beginning of a month. Exact contract values cannot be determined as they depend on various unknown factors. Therefore, the contract values for the awarded contracts can only be indicated as fictitious values based on the currently applicable threshold values.
