    Brief

    This procurement opportunity is for the supply of modified polymers for asphalt mixtures under a framework agreement lasting 2 years. The minimum value of the framework agreement is 50,000 lei (excluding VAT), and the maximum value is 3,750,000 lei (excluding VAT). The smallest subsequent contract will be valued at 25,000 lei (excluding VAT), while the largest will be 625,000 lei (excluding VAT). The minimum and maximum quantities for the framework agreement and subsequent contracts are detailed in the annexes of the specifications document. A minimum of 1 and a maximum of 4 subsequent contracts will be awarded each year, depending on allocated funds. The contracting authority reserves the right to modify the contract in accordance with Article 221 of Law 98/2016, provided that these modifications do not constitute a substantial change as defined in Article 221, paragraph 7 of the same law. Review clauses as per Article 221, paragraph (1), letter a) of Law 98/2016 anticipate potential changes during the contract execution, including: 1. Parties to the framework agreement; 2. Duration of subsequent contracts; 3. Subcontractors; 4. Payment methods and debt recovery; 5. Inspections/testing/checks; 6. Delivery of products as per the framework agreement and subsequent contract model. This framework agreement does not serve as a legal basis for public fund commitments. Contracts awarded under this framework will provide the legal basis for payment. The awarding of subsequent contracts will depend on the needs of DRDP CLUJ. The number and duration of contracts will be determined based on the budgetary funds allocated for this purpose. Deadlines for submitting requests for clarification/additional information: A. According to Article 160, paragraph (1) of Law 98/2016, any interested economic operator has the right to request clarifications or additional information regarding the awarding documentation up to 18 days before the deadline for submitting offers. B. According to Article 161, paragraph (1) of Law 98/2016, the contracting authority will respond clearly and completely to all requests for clarification/additional information by the 11th day before the deadline for submitting offers. Any request for clarification submitted after the date mentioned in point A) will prevent the contracting authority from providing a response within the timeframe mentioned in point B), and therefore, any request for clarification made after the specified deadlines will be considered late.
