Consulting Services for Risk Management in Finland

This contract involves consulting services for risk management, which will be utilized in the project operations and ongoing activities of the contracting authority, Pääkaupunkiseudun Kaupunkiliikenne Oy (KLOY). The procurement process was halted, and the contracting authority has made a decision to suspend it. The goal of the procurement was to select three (3) service providers. Services were intended to be ordered in a way that assignments would be distributed as evenly as possible among the three selected service providers throughout the contract period. The contracting authority had the right to organize mini-competitions among the selected service providers for work valued over €60,000. The estimated value of the procurement, excluding VAT, for the entire contract period (including possible option periods) was €4,320,000. The framework agreement did not include any minimum purchase obligations and did not grant the service providers exclusive rights to provide the services to the contracting authority. The contracting authority had the option to procure services as needed based on separate orders. The framework agreement had a basic contract period of two (2) years from the signing of the contract. After the basic contract period, the contract could be extended for two (2) additional periods of two (2) years each, with the contracting units deciding on the use of the option three (3) months before the end of the current contract period (i.e., basic contract period of 2 years + option periods of 2+2 years). Bids were to be submitted by July 31, 2025, at 12:00 PM. The contracting authority identified an error in the request for proposals that could not be corrected without suspending the procurement and publishing a new procurement notice: - In the criteria for the procurement object, the amount of resources offered and the calculation of the comparative price included a work quantity estimate: 'Required amount: 80 h (EUR/h)'. The time specification ('/month') was missing after the work quantity estimate. The absence of this time specification provided an unreasonably low estimate of the annual amount of service to be ordered, which was too low in relation to the procurement object. - There was also a functional error in the company reference form. The dropdown menu on the form did not work. The service provider could not utilize the selection options on the company reference form and thus could not verify the information provided on the reference form. There is a real and justified reason for suspending the procurement due to the reasons mentioned above. The decision does not have a discriminatory effect on the bidders. To ensure equal treatment of bidders, it is justified to keep the received bids confidential based on Section 24, Subsection 17 of the Act on the Openness of Government Activities (612/1999) until the contracting authority has made a decision on the new procurement procedure. The procurement procedure will be restarted later by publishing a new procurement notice in the Hilma notification channel and the TED service. It is noted separately that no bids were received before the suspension.
