Open House Discount Contracts for Pegfilgrastim in Germany

This is not a standard procurement procedure but an open-house model. The form used is for an open procedure only because there is no specific form for the open-house model. Contracts made under this model are not subject to procurement law due to the lack of a selection decision. AOK Bayern intends to enter into non-exclusive discount agreements with all interested pharmaceutical companies for the active ingredient Pegfilgrastim (ATC L03AA13) in accordance with § 130a Abs. 8 SGB V. AOK Bayern offers identical and non-negotiable discount agreements to all interested pharmaceutical companies that meet the eligibility requirements listed below. The earliest contract start date is December 1, 2025, and all contracts will end on November 30, 2027. Contracts can be concluded at any time during this period, but no later than October 3, 2027. Contracts can be terminated with one month's notice at the end of the month. If a nationwide or state-specific discount contract for medicines with the active ingredient in question comes into effect, the open-house agreements will automatically become void for the corresponding duration. A contract will be concluded with all interested pharmaceutical companies that demonstrate their eligibility by submitting a completed and signed declaration of reliability. The pharmaceutical company must submit the completed and signed contract, along with a completed and signed annex "Specification of the Contractual Medicines" and the completed and signed declaration of reliability. Documents can be submitted either in written form with a handwritten signature or electronically with a qualified electronic signature. Handwritten documents must be sent in duplicate original to the following address: AOK Bayern - Die Gesundheitskasse, Procurement Office SGB V ZE25 open-house discount contracts, Carl-Wery-Str. 28, 81739 Munich. Electronic documents with a qualified electronic signature must be submitted via the communication area on the procurement portal www.dtvp.de. If complete and correct documents are received by the 3rd of each month, the contract will start on the first day of the following month; otherwise, it will start on the first day of the month after that. For handwritten documents, a scanned copy of the complete, filled out, and signed documents must be sent in advance to the email address vergabestelle1@by.aok.de or via the communication area on the procurement portal www.dtvp.de to meet the deadline, provided that the complete and correct original documents in paper form are received by AOK Bayern, Procurement Office, by the 10th of the month. Interested pharmaceutical companies can request access to the procurement documents in the project room for the open-house procedure on the portal www.dtvp.de. A link to the portal is included in this announcement. Only pharmaceutical companies are eligible as potential contracting partners. The documents for the open-house procedure will be made available exclusively to pharmaceutical companies as potential contracting partners and must be treated as strictly confidential.
