    This procurement procedure aims to establish a supply contract for the product 'Accommodation and Administrative Unit'. The Accommodation and Administrative Unit is essential for ensuring the module's self-sufficiency in terms of accommodation spaces and optimal functioning during its operational phase. The contracting authority will respond clearly and completely to all requests for clarification or additional information by the 16th day before the deadline for submitting offers. Clarifications can be requested up to 25 days before the offer submission deadline. A suspensive clause applies: this procurement procedure is initiated under this suspensive clause, meaning that the legal commitment is contingent upon the extension of the Adaptation Grant module RO/GFFFV/02, registered under number 1011378794 - ECPP – 2023-RO-GFFFV, if the delivery deadline of the winning offer exceeds the grant's implementation period (30.11.2025). If, for any reason, the grant's implementation period is not extended accordingly within 60 days from the date of communication regarding the procedure's results, this procurement procedure will be annulled by law, provided there is no other source of funding, in accordance with Article 212, paragraph (1), letter c) of Law 98/2016, with subsequent amendments and completions, making it impossible to conclude the legal commitment. Bidders understand that the Contracting Authority cannot be held liable for any damages in the event of the annulment of the procurement procedure, regardless of the nature of such damages and whether the Contracting Authority was notified of the existence of such damages. Bidders in this procedure accept the use of the above special conditions/suspensive clause, assuming full responsibility for any damages they may suffer in the described situation. The winning bidder is required to keep their submitted offer valid and unchanged until the legal commitment is concluded. Requests for clarification regarding the procurement documentation must be submitted only through SEAP (https://e-licitatie.ro), by accessing the 'Questions' section in the details of the ongoing procurement procedure. ATTENTION!!! To respect the principle of equal treatment, interested economic operators will comply with the provisions of ANAP notification no. 247 regarding the method of submitting requests for clarifications and additional information to the procurement documentation/answers formulated in the case of conducting procurement contract award procedures through electronic means (online), meaning that the documents attached to the 'Questions' section WILL NOT CONTAIN IDENTIFYING DATA, as these will become public upon the authority's response!
