Waste Transport Services in Poland

This contract involves the ongoing collection, transportation, and management of waste generated from the thermal processing of waste at the Thermal Waste Processing Plant (ZTPO) for a period of 12 months or until the estimated quantities are exhausted. The contract is divided into two parts: Part 1 - solid waste from gas cleaning (19 01 07*), and Part 2 - fly ash containing hazardous substances (19 01 13*). A detailed description of the contract is provided in Annex 1 of the SWZ. The contract includes an option clause. If the declared minimum waste quantities (70% of the estimated maximum waste quantities specified in the OPZ) are not achieved within 12 months from the contract start date, the service will continue until the minimum quantity is reached, but not longer than 24 months from the start date. Upon reaching the minimum performance level during the extended contract period, the contract will expire, subject to the buyer's option right. The buyer must notify the contractor of this no later than the day the contract is set to expire. The extension of the contract period does not require an annex. If the maximum quantities (100% of the waste quantities specified in the OPZ) are not achieved within 12 months from the start date, the buyer has the right to extend the contract until the maximum levels are reached, but not longer than 24 months from the start date. If the maximum performance level is reached before the end of the extended period, the contract will expire. The buyer reserves the right to increase the quantity of waste collected during the extended contract period by up to 20% of the maximum order size, based on a unilateral declaration made by the contractor during the contract period. All collected waste must be processed in one of the recovery processes R1 – R11. The contract will be executed at the Thermal Waste Processing Plant in Krakow, located at Jerzego Giedroycia 23, and at the waste processing facility operated by the contractor. The buyer emphasizes the obligations related to the employment of individuals performing the contract based on an employment contract, in accordance with point 6 of the SWZ.
