    Brief

    Numera Palvelut Oy (Sarastia) is seeking bids for portable rental buildings according to the tender documents. This procurement is a construction contract. The competition will be conducted as an open procedure, with the selection criterion being overall economic advantage and the comparison basis being the best price-quality ratio. The price weight is 0 points and quality is 100 points. The tender does not require pricing of the buildings; instead, the final buildings to be rented to the customer will be defined based on needs arising during the contract period, and separate mini-competitions will be organized by the clients. A maximum of 10 acceptable bidders will be selected for the framework arrangement. Selection will be based on the scoring order of the bidders. If multiple bidders earn the same score, the procurement unit will conduct an impartial draw to select the winner, which is an accepted method in legal practice. Partial bids or alternative bids are not accepted. More detailed information on the comparison criteria and scoring is provided in the tender documents. The framework agreements are temporary, lasting four (4) years. The notice period for terminating the framework agreements is six (6) months for the procurement unit, the supplier, and the clients. Individual rental agreements or leasing agreements between the client and the supplier based on the framework arrangement may be valid for longer than the actual framework agreement. The client may also set an option for the possibility of purchasing the building as part of the rental agreement. Rental and leasing agreements must comply with the content and conditions of the actual framework agreement, and they must not contain any terms that are weaker for the client than those in the framework agreement. The logic of supplier selection and the execution of mini-competitions included in the framework arrangement are presented in the draft contract attached to the tender documents. The procurement decision does not create a contractual relationship between the procurement unit and the selected suppliers; rather, a contract is formed when the procurement decision has become legally valid, or the market court has granted enforcement permission for the contract, and both parties have signed the contract. Clients committed to the contract will immediately enter the scope of the contract when the contract period begins, or at the latest when their current corresponding procurement contracts end. During the contract period, the contract can be expanded as specified in attachment one (1) of the draft contract. The bidder agrees that the procurement unit may disclose the basic information of the contract to the customer communities specified in attachment one (1) of the draft contract without first obtaining the bidder's permission. The bidder agrees to all the conditions presented in the tender documents with their bid. The bidder does not have the right to impose their own conditions on their bid. The contract does not include a mandatory purchase obligation, nor does it grant exclusive rights to the selected supplier for the provision of products and services under the contract. Bids that are contrary to the tender, submitted late, or otherwise materially incorrect will not be accepted, and the bidder will be excluded from the procurement process under procurement law. The bidder is bound by a duty of care regarding the content and accuracy of their bid. The procurement includes portable element buildings to be delivered based on the client's needs and the mandatory and separately agreed services related to them. The buildings will be used as temporary accommodation and for more permanent use. Buildings delivered for a rental period of more than two (2) years must meet the regulations for permanent construction. The client will acquire the buildings for rent or leasing (other financing is also possible) through a simplified competition (mini-competition) conducted among the framework agreement suppliers. The client has the right to include an option for the purchase of the building into their own balance sheet. Additionally, the client has the right to include an option for land-related earthworks and municipal engineering installation works, as well as various additional services during the rental period. The client will define the options in the mini-competition tender documents and decide on their use independently. Clearing, foundation, and ground works related to the site, as well as municipal engineering installation works and other HVAC works, can be carried out by the client as their own work, as a separately procured contract, or as part of the building's mini-competition organized by the supplier. Therefore, various site, delivery, and installation services must also be obtained from the supplier, which the client and the supplier can agree on a case-by-case basis according to the terms of the framework agreement. The site may also be included in the rental agreement. The comparison basis for mini-competitions is always overall economic advantage. The buildings and related services must meet all the requirements stated in the tender documents and any specific/new requirements set by the client in the mini-competition. The supplier is responsible for the design related to the building, handling permit matters, actual construction, transferring the building to the site, its assembly and equipping, and at the end of the rental period, dismantling and site restoration according to the agreed division of responsibilities with the client. Additionally, the supplier is responsible for maintenance and upkeep work during the contract period as agreed.
