Brief
Numera Palvelut Oy (Sarastia) is seeking bids for portable rental buildings as outlined in the tender documents. This procurement is classified as a construction contract. The bidding process will be conducted openly, with the selection criteria based on overall economic advantage and the best price-quality ratio. The price weight is 0 points and quality is 100 points. The tender does not require pricing for the buildings; instead, the final rental buildings for the client will be defined according to needs arising during the contract period, with separate mini-competitions organized by the clients. A maximum of 10 acceptable bidders will be selected for the framework agreement, based on their scoring order. If multiple bidders receive the same score, the procurement unit will conduct an impartial draw to select the winner, which is an accepted practice in legal proceedings. Partial or alternative bids are not accepted. Detailed information on the evaluation criteria and scoring is provided in the tender documents. The framework agreements are temporary, lasting four (4) years, with a notice period of six (6) months for the procurement unit, supplier, and clients. Individual rental or leasing agreements between the client and supplier based on the framework agreement may be valid for longer than the actual framework agreement. The client may also set an option for the purchase of the building. Rental and leasing agreements must adhere to the content and conditions of the main framework agreement and cannot have terms that are less favorable to the client than those in the framework agreement. The logic of supplier selection and the execution of mini-competitions included in the framework agreement are detailed in the draft contract attached to the tender documents. The procurement decision does not create a contractual relationship between the procurement unit and the selected suppliers; a contract is formed once the procurement decision has become legally binding, or the market court has granted enforcement permission for the contract, and both parties have signed the contract. Clients committed to the contract will join immediately when the contract period begins or at the latest when their current similar procurement contracts end. During the contract period, the contract may be expanded as specified in attachment one (1) of the draft contract. The supplier agrees that the procurement unit may disclose the basic information of the contract to the customer communities specified in attachment one (1) of the draft contract without first obtaining the supplier's permission. The supplier commits to all conditions presented in the tender documents. The supplier has no right to impose its own conditions on its bid. The contract does not include a minimum purchase obligation, nor does it grant the selected supplier exclusive rights to provide the products and services under the contract. Bids that are contrary to the tender, submitted late, or otherwise materially incorrect will not be accepted, and the supplier will be excluded from the procurement process under procurement law. The supplier is bound by a duty of care regarding the content and accuracy of its bid. The procurement includes portable buildings to be delivered based on the client's needs, along with mandatory and separately agreed services. The buildings will be used as temporary accommodation and for more permanent use. Buildings rented for more than two (2) years must meet the regulations for permanent construction. The client will acquire the buildings for rent or leasing (other financing options are also possible) through a simplified competition (mini-competition) among framework agreement suppliers. The client has the right to include an option for the purchase of the building in its own balance sheet. Additionally, the client has the right to include options for land development work and municipal engineering installation work, as well as various additional services during the rental period. The client will define the options in the mini-competition tender documents and decide on their use independently. Site clearance, foundation, and ground works, as well as municipal engineering installation works and other HVAC works, can be carried out by the client as its own work, as a separately procured contract, or as part of the building's mini-competition organized by the supplier. Therefore, various site, delivery, and installation services must also be obtained from the supplier, which the client and supplier can agree on a case-by-case basis according to the framework agreement's conditions. The land may also be included in the rental agreement. The evaluation criteria for mini-competitions will always be based on overall economic advantage. The buildings and related services must meet all requirements stated in the tender documents, as well as any specific/new requirements set by the client in the mini-competition. The supplier is responsible for the design related to the building, handling permit matters, actual construction, transferring the building to the site, erecting and equipping it, and at the end of the rental period, dismantling and restoring the site according to the agreed division of responsibilities with the client. Additionally, the supplier is responsible for maintenance and upkeep during the contract period as agreed.
