    Brief

    This contract involves the supply of pharmaceutical products, specifically medications, for a period of 24 months. The contract is divided into 51 packages. Suppliers can only offer medicinal products that are authorized for sale in Poland according to the Pharmaceutical Law of September 6, 2001. For packages that include medical devices, suppliers must offer products that have been introduced to the market in compliance with the Medical Devices Act of April 7, 2022. All offers must comply with the provisions of the Act on the reimbursement of medicines, special dietary foods, and medical devices dated May 12, 2011. To confirm compliance, suppliers must submit specific evidence with their offers, including: a) A declaration that the offered medicinal products are authorized for sale in Poland and have valid registration certificates, which must be made available upon request after the contract is signed. b) A declaration that the offered assortment has been authorized and introduced to the market in accordance with the Medical Devices Act and has valid conformity declarations and certificates from a notified body. c) A declaration that the offered medicinal products have the required safety data sheets and will be provided upon request after the contract is signed. The contracting authority does not foresee the possibility of supplementing the required evidence. Offers lacking the necessary evidence will be rejected. Suppliers must also submit a declaration confirming their eligibility to participate in the procurement process and that there are no grounds for exclusion. This declaration must be in the form of a European Single Procurement Document (ESPD). Suppliers can use the tool available at https://espd.uzp.gov.pl/ to complete this declaration. Additionally, joint suppliers must submit a declaration indicating which supplies each supplier will provide. The offer must include a price form, a declaration of compliance with participation conditions, and any necessary powers of attorney. Note that the offer documents are integral to the submission and cannot be supplemented after submission.
