Nearest Relative Proxy Service for Mental Health Support

The Council is seeking a provider to deliver Nearest Relative Proxy services, acting as the legal Nearest Relative for individuals without appropriate family members or friends to fulfill this role, as required under the Mental Health Act 1983 (amended by the Mental Health Act 2007). The service supports individuals undergoing mental health assessments and treatment decisions where formal representation is necessary. The anticipated caseload is approximately 10 individuals per year, though the provider must demonstrate capacity and flexibility to manage between 0 and 20 cases annually. The successful provider will need to maintain operational flexibility to respond to fluctuating service demand, ensure timely availability for urgent cases, and possess understanding of mental health legislation and advocacy responsibilities. This is a legal compliance service essential to safeguarding vulnerable individuals in the mental health system.
