Town Planning Legal Advice Services for Frimley Health NHS Trust

Frimley Health NHS Foundation Trust is seeking a specialist town planning legal services provider to support the New Hospital Programme across three sites: Frimley Park Hospital, Heatherwood Hospital, and the Trust's existing estate. The provider will deliver comprehensive legal advice, documentation, negotiation, and representation on all town and country planning matters under English and Welsh law throughout RIBA design stages 2 to 4. Key responsibilities include: developing planning strategies and risk assessments; advising on planning applications, consents, and conditions; managing heritage and listed building consents; negotiating and drafting section 106 agreements and Community Infrastructure Levy advice; coordinating highway and transport agreements; managing planning appeals, inquiries, and hearings; providing enforcement compliance guidance; advising on judicial review and statutory challenges; delivering Environmental Impact Assessment and Habitats Regulations Assessment support; and ensuring governance and decision-making compliance. The provider will work collaboratively with the Trust's planning consultants and design teams, operating from a live acute healthcare facility. The initial commitment is for RIBA Stage 2, with an anticipated overall contract term of up to two years depending on project progress and planning approval timelines. The Trust reserves the right to extend the contract to include RIBA Stages 4 and 5. This is an open procurement under the Procurement Act 2023, with submissions assessed on mandatory pass/fail conditions of participation criteria.
