    Brief

    The Food Safety Act 1990 mandates that Local Authorities (LAs) appoint Public Analysts (PAs) for chemical and compositional food sampling in legal contexts. PAs must provide a Certificate of Analysis (CoA) that is admissible as evidence in criminal proceedings. Achieving the necessary MChemA qualification to become a PA is challenging, ensuring that analysts possess extensive knowledge in chemical analysis and can provide expert legal opinions on food quality, safety, and integrity. A shortage of PAs limits the capacity for analyses that require specialized training. Additionally, if Public Analysts lose their position due to retirement or failure to appoint a new analyst, they will be unable to test samples under the Food Safety Act, hindering enforcement actions. Funding is needed for the training and continued professional development (CPD) of PAs, as well as for backfilling desk analyst roles in laboratories. This investment will enhance the capacity and capability of Public Analysts, as outlined in the Food Standards Agency (FSA) Board Paper 2022. Establishing a succession plan is crucial for the future of the Public Analyst profession and the Public Analyst system.
