    Brief

    This contract involves the supply of laboratory reagents and control materials, along with the leasing of analyzers for the Independent Public Provincial Hospital in Szczecin. The contractor is required to fulfill the order according to the terms outlined in the contract draft, which is attached as Annex 4 to the SWZ, and in the Detailed Description of the Subject of the Order, which is attached as Annex 1 to the SWZ, along with Annexes 1A and 1B. The execution location for this contract will be the Independent Public Provincial Hospital in Szczecin, specifically at the following addresses: 1) Laboratory Diagnostics Warehouse at Arkońska 4 (Building I), 2) Laboratory Diagnostics Department at A. Sokołowskiego 11 (Building E), 3) Medical Warehouse at Arkońska 4, and 4) Medical Warehouse at Sokołowskiego 11. The contracting authority does not require the contractor to personally perform key tasks related to the contract; subcontracting is allowed. If the contractor intends to use subcontractors, they must specify in their offer which parts of the order will be subcontracted and provide the names of any known subcontractors. If no subcontracting is indicated in the offer, the contractor may only introduce subcontractors under the conditions specified in the contract. The contracting authority does not impose requirements regarding employment contracts for individuals performing tasks related to the order. The contracting authority does not foresee the possibility of awarding contracts as mentioned in Article 214, paragraph 1, point 8 of the PZP. The contracting authority allows for equivalent solutions/products to be offered only when the subject of the order is described using trademarks, patents, or specific processes that characterize the products or services provided by a specific contractor, or by referring to standards, technical assessments, technical specifications, and reference technical systems, in accordance with Article 101, paragraph 4 of the PZP. The contracting authority will indicate the possibility of equivalent solutions by including the terms 'or equivalent' in the description of the order or by referencing a specific standard, technical assessment, or technical specification. When offering an equivalent solution, the contractor must demonstrate in their offer that the proposed equivalent solution meets the contracting authority's requirements as well as or better than the originally described solution, particularly in the Detailed Description of the Subject of the Order. Evidence submitted with the offer to demonstrate the equivalence of the proposed solutions may include catalog sheets, brochures, manufacturer or distributor folders, expert opinions, and documents from independent reviewing entities. The burden of proof for demonstrating the equivalence of the proposed solutions lies with the contractor. Failure to demonstrate equivalence will result in the rejection of the offer based on Article 226, paragraph 1, point 5 of the PZP.
