    Brief

    The supplier is required to deliver the requested products to the contracting authority's location, adhering to the specifications outlined in the accepted offer and meeting the minimum requirements specified in the terms of reference. Delivery must be made by the supplier according to the timeline agreed upon in the technical proposal, but no later than the deadline specified in the terms of reference, which begins from the date of signing the subsequent supply contract. Any requests for clarifications must be submitted through SEAP (https://e-licitatie.ro/). According to Article 160 of Law 98/2016, amended by OUG 107/2017, interested economic operators must request clarifications or additional information regarding the award documentation at least 18 days before the deadline for submitting offers. In accordance with Article 161 of Law 98/2016, amended by OUG 107/2017, the contracting authority will respond on the 11th day before the deadline for submitting offers. SUSPENSIVE CLAUSE - this public procurement contract award procedure is initiated under the following suspensive clause: The award of the public procurement contract is conditioned upon the allocation of budget credits for the 2024 budget year during the approval of annual budget laws and rectification laws necessary for the purchases outlined in the project. Therefore, the completion of the award procedure through the signing of the public procurement contract is subject to the following condition: - the signing of the public procurement contract is conditioned upon obtaining budget credits from the Ministry of Public Finance through the Romanian Academy for the implementation of the Project activities, with the contract being possible only if budget credits are secured at a level that covers the expenses planned for the 2024 budget year, including the commitments of the contracting authority through the signing of these contracts. - if the budget credits requested by the contracting authority for the purchase of the products subject to the award procedure are not realized within a maximum of 110 working days from the deadline for submitting offers, the contracting authority will apply the provisions of Article 212 paragraph (1) letter c) second thesis of Law no. 98/2016, making it impossible to conclude the public procurement contract. - Bidders in this procedure accept the use of the above suspensive condition, assuming full responsibility for any potential losses they may incur in the described situation.
