Brief
The aim of this procurement procedure is to conclude a framework agreement with one or more participants who, before signing the contract, must demonstrate compliance with all required qualification criteria and the eligibility set by the contracting authority for the execution of the public contract. The significance of the framework agreement lies in the fact that the contracting parties, where they anticipate a long-term business relationship (in this case, a relationship for 4 years from January 1, 2025, to December 31, 2029), establish through the concluded framework agreement the basic rules that will govern all specific (so-called implementation) contracts concluded on its basis in the future, unless otherwise agreed in a specific implementation contract. The framework agreement thus serves to set the contractual conditions for subsequently concluded specific implementation contracts, i.e., it predetermines their content to some extent. When an implementation contract is formed based on the framework agreement, the rules (contractual conditions) agreed upon in the framework agreement become part of the content of the implementation contract to the extent that the parties have not agreed otherwise in the implementation contract. Regarding the scope of the required performance – services of specific implementation contracts: This involves the disposal (pumping + transport + disposal) of wastewater from the leachate pit of the SONO landfill site. The quality of the wastewater is verified by the contracting authority through water analysis (see attached document), which is conducted by an accredited laboratory, and it is allowed to take a sample for independent analysis. Leachate will be preferentially reused for backflow on the landfill. In case of excess leachate, it will only be disposed of at appropriate wastewater treatment plants after verifying its quality in accordance with the valid operational regulations of the treatment plant. The technology for treating leachate must comply with the current state of technical progress due to its composition. Records of the pumping duration and method of disposal of leachate will be kept in operational records. It is possible, depending on climatic conditions and extraordinary events (e.g., fires), that the estimated quantity will be exceeded, based on actual influences; however, the contracting authority can confirm from its previous practice that it does not expect the quantity of wastewater to exceed 1,000 tons per month under all circumstances. The contracting authority anticipates that the services will be performed from January 1, 2025, to December 31, 2029, with the framework agreement being concluded for a period of 4 years.
