    Brief

    The contracting authority wishes to purchase endoprosthesis materials as described in the annex to the specifications, divided into 26 lots. The specific objectives of the procurement aim to support and improve medical services. Considering the nature of the procurement and the technical characteristics, it can be considered that the procurement is highly complex. The department requests the initiation of the public procurement procedure because the framework agreements currently in force for endoprosthesis materials will expire in February 2025. The request follows the necessity report no. 34/29.10.2024, in accordance with the Justification Note no. 1341/05.11.2024, prepared by Chief Orthopedic Doctor - Dr. Anitas Razvan, approved by the unit manager. The reason for requesting the consolidation of products into a single lot for lots 1, 2, 3, 4, 5, 7, 8, 9, 10, 18, 19, 22, 23, 24, 25 is as follows: the products are intended for the treatment of complex pathologies that require compatibility with each other and with the instruments, which is why these lots constitute an interdependent ecosystem. These surgical interventions become much more difficult or even impossible if the implants used are not from the same system, making their procurement unnecessary. Since all products in a lot must be compatible with each other, each lot constitutes a package of specific products for which the public procurement procedure is desired. It is noted that for the products identified in report no. 34/29.10.2024, there are valid framework agreements until 28.02.2025. The necessity report and the technical characteristics in Annex 1 to the specifications comply with all legal provisions of Law 98/2016 regarding public procurement and HG395/2016 with subsequent amendments. The technical specifications for each lot can be found in the specifications Annex 1 and in the annex to the contracting strategy. A framework agreement will be concluded for a period of 36 months. Within a calendar year, it is estimated that a minimum of 1 subsequent contract and a maximum of 12 subsequent contracts will be concluded, with the frequency of the largest subsequent contract being able to be concluded every 12 months. The estimated minimum and maximum quantities of subsequent contracts can be found in Annex 1 of the contracting strategy and the specifications, and these will be concluded based on the needs of the contracting authority, with the minimum and maximum quantities being estimates. The contracting authority is not obliged to purchase either the minimum or maximum quantity during the framework agreement, as specified in the annex. Additionally, the quantity expected to be purchased during the framework agreement and specified in the award documentation will be purchased based on the availability of allocated funds for this purpose and the needs of the contracting authority. In justified cases, the maximum estimated quantity in the framework agreement may be increased in accordance with the provisions of Article 221 of Law 98/2016 regarding public procurement. The deadline for the contracting authority to respond clearly and completely to all requests for clarifications/additional information will be the 11th day before the deadline for submitting offers, according to Article 160 in conjunction with Article 161 of Law 98/2016 with subsequent amendments. The number of days in which clarifications can be requested before the deadline for submitting offers/candidacies is 20 days.
