Orthopedic Implants Procurement

The contracting authority seeks to purchase osteosynthesis products as detailed in the specifications document, divided into 56 lots. The specific objectives of this procurement aim to support and improve medical services. Given the nature of the procurement and its technical characteristics, it is considered to have a high degree of complexity. The specialist requests the initiation of the public procurement procedure while adhering to the lot division outlined in necessity report NR.10/14.02.2024. The reason for combining products into a single lot for lots 30, 31, 32, 33, 34, 35, 37, 43, 49, 51, and 52 is that these products are intended for the treatment of complex pathologies that require compatibility with each other and with the instruments used. Therefore, these lots form an interdependent ecosystem. Surgical interventions become significantly more difficult or even impossible if the implants used are not from the same system, rendering their procurement unnecessary. The technical specifications for each lot can be found in the specifications document, Annex 1, and in the annex to the contracting strategy. A framework agreement will be concluded for a period of 24 months. Within a calendar year, it is estimated that a minimum of 1 and a maximum of 4 subsequent contracts will be concluded, with the largest subsequent contract potentially being awarded every 3 months. The estimated minimum and maximum quantities for the subsequent contracts are detailed in Annex 1 of the contracting strategy and the specifications document, and these will be concluded based on the needs of the contracting authority, with the minimum and maximum quantities being estimates. The contracting authority is not obligated to procure either the minimum or maximum quantity during the framework agreement, as specified in the annex. Additionally, the quantity expected to be procured during the framework agreement, as specified in the award documentation, will depend on the availability of allocated funds for this purpose and the needs of the contracting authority. In justified cases, the maximum estimated quantity in the framework agreement may be increased in accordance with the provisions of Article 221 of Law 98/2016 on public procurement. The deadline for the contracting authority to respond clearly and completely to all requests for clarifications/additional information will be 11 days before the deadline for submitting offers, in accordance with Article 160 in conjunction with Article 161 of Law 98/2016, with subsequent amendments and completions. The number of days in which clarifications can be requested before the deadline for submitting offers/candidacies is 20 days.
