    Brief

    The contracting authority seeks to purchase laboratory reagents as detailed in Annex 1 of the specifications, divided into 20 lots. This procurement aims to ensure the availability of reagents and kits for determining blood alcohol levels, as well as consumables and reagents necessary for drug analysis, psychoactive substances, and medications for living persons and corpses. These analyses will be conducted exclusively in the Toxicology Laboratory of the Satu Mare Forensic Medicine Service. This procurement procedure is essential because the Framework Agreement for purchasing standard kits for determining blood alcohol levels expires on June 16, 2025. Additionally, for the LC-MS (Liquid Chromatography coupled with Mass Spectrometry) device purchased in 2024, there is no framework agreement in place for the reagents and consumables needed for drug analysis. The technical specifications for each lot can be found in the specifications document, Annex 1, while the estimated quantities and values are detailed in the contracting strategy annex and Annex 2 of the specifications. A framework agreement will be established for a period of 36 months with three economic operators. It is anticipated that a minimum of one subsequent contract and a maximum of twelve subsequent contracts will be concluded within a calendar year, with the largest subsequent contract potentially being awarded every 12 months. The estimated minimum and maximum quantities for subsequent contracts are outlined in Annex 1 of the contracting strategy and Annex 2 of the specifications, and these will be concluded based on the needs of the contracting authority, with the minimum and maximum quantities being estimates. The contracting authority is not obligated to purchase either the minimum or maximum quantities specified in the annex during the framework agreement. Furthermore, the quantity expected to be purchased during the framework agreement, as specified in the award documentation, will depend on the availability of allocated funds for this purpose and the needs of the contracting authority. In justified cases, the maximum estimated quantity in the framework agreement may be increased in accordance with Article 221 of Law 98/2016 on public procurement. The deadline for the contracting authority to respond clearly and completely to all requests for clarifications/additional information will be 11 days before the deadline for submitting offers, in accordance with Article 160 in conjunction with Article 161 of Law 98/2016, with subsequent amendments and completions. The number of days in which clarifications can be requested before the deadline for submitting offers/candidacies is 20 days.
