Technical Studies Contract for Marseille Public Schools

This framework agreement is for conducting structural studies on behalf of the Marseille Public Schools. The work will take place in primary schools across Marseille. The agreement is established with two economic operators, and pricing will be based on unit and lump-sum prices. If a complex or atypical task requires new pricing (over 50% of the estimate), the project owner may choose to solicit bids from both contractors based on a specification to be developed by them. The evaluation criteria for subsequent contracts will include price and the weighting of chosen criteria. Other contractual provisions, particularly regarding administration (price variations, penalties, etc.), will remain unchanged. Orders will be placed as needed through purchase orders according to the prices in the BPUF/DQE. The framework agreement will be executed with two economic operators, alternating orders as needs arise. If one contractor is unavailable, the project owner may call on the other. Additionally, a specific school operation (School X) will be conducted by a single provider to ensure continuity. There will be no negotiation or re-competition, except in exceptional cases for subsequent contracts, with the following financial limits: no minimum commitment and a maximum commitment of 2 million euros excluding tax over the duration of the framework agreement (including renewal periods of 4 years). If the maximum commitment is reached during the execution period, the agreement will end (unless amended according to public procurement regulations). The contract is unique and will not be divided into lots. The contracting authority has decided against dividing the contract for technical reasons, as it would complicate the execution of services. Additionally, geographical division is not feasible as all sites are not yet known. Therefore, a single contract will be awarded for the execution of the services, which will be concluded with a single company or a group of companies.
