Software Package and Information Systems for Construction Authorities

The ITeBAU system enables 73 local building authorities across five federal states in Germany (Lower Saxony, North Rhine-Westphalia, Hesse, Mecklenburg-Vorpommern, and Baden-Württemberg) to process building applications digitally. Over 250,000 building regulation decisions have already been issued through ITeBAU, making it the leading system for digital processing of building applications in Germany. The current technological foundation of ITeBAU, conject PM, will reach its end-of-life on December 31, 2025. By this date, all 73 clients must migrate to a successor solution. Specific technical requirements have been defined for this successor solution, which the contracting authority considers essential. These requirements are justified by clear, objective, and contract-related reasons. According to the contracting authority's knowledge, the technical requirements can only be met by the Dalux product from Dalux Germany GmbH. No other interested parties have responded to the prior announcement of the intention to award the contract to Dalux Germany GmbH, which included the relevant technical requirements. Therefore, a negotiation procedure without a competitive bidding process was conducted exclusively with Dalux Germany GmbH in accordance with §14 Abs.4 Nr.2 lit. b VgV, and the contract was awarded to them. The decision to choose this procurement method followed a thorough examination of the facts and legal situation, as well as comprehensive market research.
